By using our virtual consultation services, you agree to the following terms and conditions designed to ensure compliance with HIPAA and applicable healthcare regulations to protect your health information and ensure quality care.

1. Service Description

HealthyWealthyPHOOD Solution provides virtual nutrition consultations through secure electronic communication channels. These services include nutrition assessment, personalized dietary planning, medical nutrition therapy, lifestyle coaching, and follow-up care conducted remotely via video conferencing, phone, or secure messaging.

Our services are offered to support your health and wellness goals and should complement, not replace, care from your primary healthcare provider.

2. Privacy and Confidentiality

Your privacy is our top priority. All personal health information (PHI) shared during virtual consultations is protected under the Health Insurance Portability and Accountability Act (HIPAA). We use secure, encrypted platforms to maintain confidentiality and prevent unauthorized access to your sensitive health information.

Key Privacy Commitments:

No recordings or sharing of your consultation will occur without your explicit written consent.
Your health information will never be sold, shared, or disclosed to third parties without authorization, except as required by law.

4. Risks and Limitations

While virtual consultations provide significant convenience and accessibility, you acknowledge and understand the following risks and limitations:

Technology Limitations:

Technical failures, internet outages, or video/audio disruptions may occur, which could affect the quality or continuity of your consultation.
Virtual consultations cannot replicate all aspects of in-person medical evaluation.
Loss of internet connection or device failure may require rescheduling your appointment.

Clinical Limitations:

Some health conditions may require in-person physical examination or laboratory testing beyond the scope of virtual nutrition consultation.
If a condition requires urgent medical attention or emergency care, HealthyWealthyPHOOD Solution will advise you to seek immediate medical care through emergency services (911) or your primary healthcare provider.
Nutrition recommendations are based on the information you provide; incomplete or inaccurate information may affect the quality of your care.

No Guarantee of Results:

Nutrition outcomes depend on your adherence to recommendations, your individual metabolism, genetics, lifestyle factors, and overall health status.
We do not guarantee specific health outcomes or results from following our nutrition guidance.

5. HIPAA Compliance and Health Information Protection

HealthyWealthyPHOOD Solution adheres strictly to HIPAA guidelines to ensure the protection of all personal health information and maintain patient privacy and security.

Compliance Standards:

All patient records are stored in secure, encrypted systems with access controls limiting availability to authorized personnel only.
We conduct regular security audits and updates to protect against unauthorized access and data breaches.
Patient information is retained according to legal requirements and destroyed securely when no longer needed.
We maintain a Business Associate Agreement (BAA) with any vendors or platforms that handle your health information.
In the event of a breach of security or unauthorized access to your health information, you will be notified in accordance with HIPAA requirements.

By scheduling and participating in a virtual consultation with HealthyWealthyPHOOD Solution, you:

Consent to receive nutrition consultation services electronically via secure video conferencing, phone, or messaging.
Acknowledge understanding of the risks, limitations, and benefits of virtual consultation compared to in-person care.
Confirm that you understand virtual consultations are not a substitute for emergency medical care or in-person medical evaluation.
Authorize HealthyWealthyPHOOD Solution to use secure communication platforms and electronic health records to manage your care.
Consent to the collection, use, and storage of your health information in accordance with HIPAA and our Privacy Policy.
Understand that nutrition guidance does not constitute medical diagnosis or treatment and that you should continue working with your primary healthcare provider.

7. Payment and Billing Terms

Service Fees:

Personalized Nutrition Assessment & Consultation: $100 per session
Medical Nutrition Therapy for Chronic Conditions: $120 per session
Nutrition Counseling & Follow-Up Sessions: $90 per session
Sports Nutrition Planning: $110 per session
Weight Management Programs: $100 per session
Maternal Nutrition Support: $95 per session

Payment Policy:

Payment is due at the time of service or as otherwise agreed upon in advance.
We accept major credit cards and secure payment methods through our billing system.
Unpaid invoices may result in suspension of future services.

Insurance and Reimbursement:

You are responsible for verifying whether your health insurance covers nutrition services.
HealthyWealthyPHOOD Solution does not guarantee insurance reimbursement.
You may request an itemized receipt for submission to your insurance provider or for claiming reimbursement through your Flexible Spending Account (FSA) or Health Savings Account (HSA).

8. Cancellation and Rescheduling Policy

Appointment Cancellations:

Cancellations must be made at least 48 hours before your scheduled appointment.
Cancellations with less than 48 hours’ notice may result in a full session fee being charged to your account.
No-shows (missed appointments without cancellation or notification) will be charged the full consultation fee.

Rescheduling:

Appointments may be rescheduled through our online booking system at least 48 hours in advance at no charge.
Emergency rescheduling requests will be accommodated when possible.

9. Limitations and Disclaimers

Important Disclaimers:

HealthyWealthyPHOOD Solution’s services are provided for educational and nutritional guidance purposes only. Nutrition guidance is not medical diagnosis, treatment, prescription, or cure for any disease or medical condition.

Racquel Housen is a clinical nutritionist and is not a physician. Nutrition consultations do not replace medical care from a licensed healthcare provider.
Our services do not diagnose, treat, cure, prevent, or mitigate any disease or medical condition.
Clients should continue working with their primary care physician and other healthcare providers for medical management of health conditions.
If you experience severe health symptoms or a medical emergency, contact emergency services (911) immediately.

Assumption of Risk:

You assume all risks associated with following the nutrition recommendations provided by HealthyWealthyPHOOD Solution. Any adverse health effects, allergic reactions, or complications arising from following nutritional guidance are the responsibility of the client, not the provider.

10. Limitation of Liability

Maximum Liability:

HealthyWealthyPHOOD Solution’s total liability for any claims arising from your use of our services shall not exceed the amount you paid for services in the 12 months prior to the claim, or $500, whichever is greater.

Excluded Damages:

In no event shall HealthyWealthyPHOOD Solution, Racquel Housen, or any staff members be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill, even if advised of the possibility of such damages.

Not Responsible For:

Adverse health outcomes or side effects from following nutritional recommendations.
Failure to achieve expected health results due to non-compliance with recommendations.
Technical failures, internet outages, or communication disruptions beyond our control.
Consequences of providing inaccurate or incomplete health information.

11. Intellectual Property

All content on the HealthyWealthyPHOOD Solution website, including nutrition plans, educational materials, articles, recipes, meal planning frameworks, and proprietary recommendations, is the intellectual property of HealthyWealthyPHOOD Solution and Racquel Housen.

You may use nutrition plans and educational materials for your personal, non-commercial use only.
You may not reproduce, distribute, republish, sell, or use any content for commercial purposes without written permission from HealthyWealthyPHOOD Solution.
Personalized nutrition plans created specifically for you are for your individual use and may not be shared with others or used commercially without explicit consent.

12. Termination of Services

HealthyWealthyPHOOD Solution reserves the right to:

Refuse or discontinue services if you breach these Terms and Conditions.
Terminate services if you provide false, misleading, or incomplete health information that compromises the quality of care.
Discontinue services if your condition requires medical intervention beyond the scope of nutrition consultation.
Suspend services if payment is not received or outstanding invoices remain unpaid.
End the professional relationship if continuing to provide services would be clinically inappropriate or unsafe.

13. Indemnification

You agree to indemnify, defend, and hold harmless HealthyWealthyPHOOD Solution, Racquel Housen, and all staff members from any claims, damages, losses, or expenses (including attorney fees) arising from:

Your use of our services or website.
Your breach of these Terms and Conditions.
Your violation of any applicable law or third-party rights.
Your non-compliance with nutrition recommendations or medical advice.

14. Modifications to Terms

HealthyWealthyPHOOD Solution may modify these Terms and Conditions at any time at our sole discretion. Changes will be effective immediately upon posting to our website. You are responsible for regularly reviewing these Terms.

Your continued use of our services after modifications constitutes your acceptance of the revised Terms and Conditions.

15. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the State of New Jersey and the United States, without regard to conflict of law principles.

Any disputes, claims, or legal proceedings arising from these Terms or our services shall be resolved exclusively through binding individual arbitration in accordance with the rules of the American Arbitration Association (AAA).

You agree to waive your right to a jury trial and any right to participate in a class action lawsuit.

16. Dispute Resolution and Arbitration

Before initiating any legal proceedings, we strongly encourage you to contact us directly to attempt to resolve any disputes informally.

If informal resolution is unsuccessful within 30 days, any remaining disputes shall be resolved through binding individual arbitration as the exclusive remedy, not through court litigation or class action.

17. Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that specific provision shall be severed and removed, and all remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms and Conditions, together with our Privacy Policy, Informed Consent Form, and any Client Service Agreement, constitute the entire agreement between you and HealthyWealthyPHOOD Solution regarding our services and supersede all prior agreements, understandings, and negotiations.
